1.The Supreme Court decided it could not make a decision in favor of the woman due to the different levels of discriminatory in each state and situation. Since there was no policy violated of discrimination in the company they couldn’t fulfill the requirements for the lawsuit and commonality. Since the court kept using that term and making sure to abide to the rules and not on the problem caused by this society disappoints everyone. Makes me think that only the wealthy company will win because they don’t want to admit defeat and even against 1.5 million woman they only care about their reputation.
Vanessa Gutierrez- Supreme Court
1.The court system is better at protecting the individual because they do it based off the constitutional laws and not to please the public. One example is Ernesto Miranda even though he was arrested for kidnapping and rape the Supreme Court ruled in favor for him in one aspect. He won because the evidence of the letter containing he admitted the crime was in violation of his fifth amendment and sixth. The police obtained this without them reading his Miranda rights as it is natural for them to interrogate the suspect. However even though he won the appeal he was still convicted with other evidence.
2. It can be anti- democratic because they are appointed by the government and confirmed by the senate. They are served for life and can be used in favor based on their views whether it be conservative or liberal. This is to avoid conflicts with the majority public opinion due to different groups having different opinions and this could put minorities rights at risk. This is based on the Federalist #10 because even if the supreme court is appointed the courts can still protect people’s rights.
Vanessa Gutierrez- Protected or not?
- Since there are so many citizens with many cultures even If they are coming from Europe. The Establishment Clause helps prevent favoring one religion. With the Lemon Test, there are requirements for a law to pass so that it is not considered unconstitutional.
2. It is protected by the First Amendment because it is a form of expression, and just because people don’t like it, no harm can be done to the person by the government. From the court case, it was determined that it was a symbolic act of political expression.
3. It means they are invoking their Fifth Amendment right against self-incrimination. This helps protect you from saying anything to detectives or police officers, as it could be used in court to determine if they are guilty.
Vanessa Gutierrez- Freedom or Secuirty?
- It is different because the citizens want some type of reassurance or unity that the country is taking measures to prevent such an attack to not happen again. Yet with so many issues and concerns, there’s bound to be those who haven’t experienced the tragedy who can’t sympathize but only worry about how this could affect their rights and privacy. This war has to take a different strategy, which is putting up more countermeasures but also having access to information from citizens to prevent such danger. Which is why it is controversial because discrimination can happen so easily while trying to protect another.
- It seems to violate the fourth amendment because police already have the power to search houses but can’t do it without a warrant. Yet for Roving Wiretaps it access more information that could be used for minor crimes. Meaning more privacy would be dive in to but not enough cause to determine if that’s okay. Which the fourth amendment protects from unreasonable searches. Without anyone to supervise this broader search it makes people uneasy that the government is too involved.
- It also violates the Fourth Amendment because it is not the immediate notice of searching anyone’s home and property. This yet again raises tensions between freedom rights and citizens. Unfortunately, because of the tragedy, the countermeasures are questioned, but everyone has a right to do so not everyone is the same.
Vanessa Gutierrez-Our role
- For federal the citizens vote for their leaders just like in our country voting for who we need to get our needs and representation heard. For the confederation system central government is weak and states make the decisions. For Unitary system the government holds most power. Yet there are local governments but are controlled by the national government.
- The division of power is spreading the authority to other branches to keep everyone in check even the president.
- The federal government shaped the actions because it decided how much funding would be given and what resources their state need. As well as recommendations that are needed for each state to go by even though there were different pov and people were slow to acclimate it showed by the deaths.
Vanessa Gutierrez – Self Interest and Greed
- The class secluded and not allowed in the process was women, slaves, native Americans, and poor white men. The class that wrote the Constitution was wealthy, white men who owned properties and had substantial wealth. In reading 6.1, “In the period from the American Revolution to the Constitutional Convention (1776–1787), the big landowners, merchants, and bankers exercised a strong influence over politico-economic life, often dominating the local newspapers that served the interests of commerce.” This was how it started how their society accepted that this class should determine how to regulate problems and control people. Determining who had influence and who was actually human in their eyes made the lower class not have a conscious about how they should make their presence known. The ones who were okay because their needs needed to be met only mattered right there and then. In reading 6.2 “the slaves, the indented servants, the mass of men who could not qualify for voting under the property tests imposed by the state constitutions and laws, and women, disenfranchised and subjected to the discriminations of the common law”. Having no voice leads to discrimination till this day which is insane we can still not break this “norm” in our anxiety of who is wealthy and surviving and who is poor. Years and years of being kept the same and not changing is why there has been little progress and why people till this day have a fixed mindset. The wealthy only want to quench their debt problems because with new freedom that is why they wanted to write the constitution. However they only wanted to make sure their problems were solved and continue to survive because there was a lot of money problems within the 13 states. Yet the problems of the miniorties and women were non existent because they weren’t considered human.
- I would say it is the same because things have stayed the same for a long time. So things that are rooted, because years went by without change, that’s why there are usually a class who has wealth and who doesn’t this created a vicious cycle. Problems stayed the same just a different society changing slowly accepting new labels and ideas. Yet we battle theories that have the same foundation yet develop with what president we have.
- The founders feared that they would be overthrown if the poor united and there would be no control. The minorities were growing steadily yet the wealthy wanted to stay in power because that’s what they knew best. Thats why the people that were elected that were from the wealthy class such as landowners, merchants had a role in the constitution but as well as benefited at the same time to represent others who have the same jobs.
Vanessa Gutierrez-Controlling the effects
1.The concept faction reminds me of republican and democrats because of the video shown before how people are grouped together on certain issues they have good or bad and want their voice heard in their government.
2. The constitution protects the people who have properties which are the wealthy. The poor people don’t have properties because there is no foundation. Without it there is no beginning to start their wealth and have a say or presence in the constitution or society without something to protect.
3. Without opportunities and equal representation, without a chance in the beginning. Everyone can be hardworking but without any say or chance of having that wealth or stability this imbalance will keep happening. Were humans and the ones who have more power will want to keep having it and keep it the same way.
4. To protect the wealthy and not let the poor overthrow them. For the wealthy to keep having control and have their necessities meet. While the poor keep struggling to survive for years and years. Its not any different from today because once a system is set it is hard to break but there are more programs helping today yet there will always be an opposing side to control and break at any opportunity.
5. It is about controlling those effects. Handling so many problems at once is difficult and satisfying many groups is difficult without any foundation. In my opinion the foundation that was set is breaking up today so having too much control isn’t good because it doesn’t bring any change. Yet its which group is bringing the change that will break the country. Every class will be affected but the chance of survival is greater for those who have money.
Vanessa Gutierrez- Wealth Inequalities
- The fact that capitalists and business owners know to invest their money and rely on it to live comfortably. Even if lower-income individuals invest money, it isn’t as much and not as significant as compared to business owners.
- The implications are exploiting workers’ labor power. Encouraging workers to work faster for the same amount of money as everyone else, just because they do it better. I do see it every day because working in retail, you see favoritism happen where some workers get more hours, but they look tired and drained due to the stress from management and customers.
Vanessa Gutierrez- MCM
Money is used to purchase the product tools and necessities and then C is for labor power needed to assemble the product. Then lastly money again but the profit made when selling the product and not giving the worker the value of their labor but the bare minimum. Which gives them profit.
Vanessa Gutierrez- Labor and value
1.Production would be tools such as toy parts and screws to put together a toy together and to mass produce a lot of them. Whereas labor is human involvement to put out the products for the company while getting paid to do so, that leads to dependency on capitalists to bring out production.
2. Something that gives value is because the community needs it to survive. Without interests or use in our daily life there is no value.
3. Labor and value are related because they go hand in hand without the other that’s why time is money. Time going into making products, you would want a reward and society to take an interest in making a profit.
4. The difference is the actual time spent working when you are working at a company. The deal was made when hired to carry out the work that was assigned.
5. Surplus value is the extra value that workers did but the owners keep to make a profit. IT is important to study about this to understand how capitalism works and how we view companies. In my opinion it makes it difficult to work hard at a job that just wants to make a profit and doesn’t really care about their workers. Yet I realized everyone has their own survival.
