The Supreme Court in Wal-Mart Stores, Inc. v. Dukes ruled that the group of women suing Wal-Mart for gender discrimination could not continue their class-action lawsuit. The Court examined the requirement of “commonality” which demands that all class members share identical legal or factual questions. The justices determined that the women failed to demonstrate sufficient evidence of a company-wide discriminatory policy which impacted all employees equally. The company’s pay and promotion decisions operated through individual local managers so there existed no single company-wide policy responsible for the alleged discrimination. The Court decided against class action status because the plaintiffs failed to establish a unified issue that applied to the entire group.
