According to Patricia Williams, the “War on Terror” is unprecedented because the enemy is not centralized, it is global in scope, and its ethics are complicated, which is distinct from traditional wars. The measures authorized in the Patriot Act, such as “roving wiretaps” and “sneak and peek” warrants, implicate Fourth Amendment issues regarding unreasonable searches; the monitoring of speech could also engage First Amendment concerns, due to prior restraint; and issues of due process arise from delayed notification.
