1.Capitalism is inherently racialized, white people are usually more privileged and at a point of time held dominance above blacks. There are race based hierarchies , race intersects with capitalism . 

2.Gilmore makes the point that criminals are being created by the criminal justice system , I agree with her point of view based off the examples she gave. First thing I agree with is that they target vulnerable communities and are bias based off of racism where minorities are targeted basically overall they target communities it’s all a cycle. 

3.What I understand by when Prof.Gilmore says liberation struggle is that there’s always a fight for fairness and equality , people come together to fight/ challenge unfairness . A attempt to make the world equal and free or discrimination  


According to MLK, how can we tell the difference between just and unjust laws?

1. “An unjust law is a human law that is not rooted in eternal law and natural law. Any law that uplifts human personality is just. Any law that degrades human personality is unjust.”

In your view, is this an important distinction (between just and unjust laws), do you think it makes a difference in the way someone (as an individual, or our society as a whole) lives their lives? Can it affect our politics?

    2. This is a very important distinction between just and unjust laws, unjust laws is individually how people want to move for example segregation being a unjust law which doesn’t uplift human personality and is not natural law,

    The way one lives their life does affect society as a whole if it’s injustice to other people 

    Based on our discussion of Question 1, give an example each, of an unjust and just law, in the US today. Explain what makes it unjust or just (using MLK’s definition of those two types of laws).

    3. A law today in the Us could be the protection of gender identity like the laws to protect LGBTQ+ or even the rights women have equal to men that prohibited discrimination compared to the earlier days. Like Martin Luther king jr said it upholds fairness and equality 

    While a unlaw would be something that violates principals of fairness which would probably be maybe the difference in minorities and low income communities or even the things we learned about capitalism 

    Commonality means whether all the plaintiffs in a class action lawsuit have enough common issues or claims to justify being grouped together in one case , there fore they decided against it because they didn’t demonstrate the commonality that the judges felt were necessary they didn’t reflect it being a company issue more of a “ personal store “ thing within the managers etc even though it was all Walmarts. Without a common issue it could not be considered a class action.  

    The court system is better suited to protect the individual in several ways compared to the elected branches of government in ways one being  independence of the judiciary, which allows judges to apply law without being persuaded  by political considerations or public opinion. For example, in the United States, the Supreme Court has the authority to review laws passed by Congress to make sure they go with the constitution this protects individual rights 

    I do agree that this Supreme Court anti-Democratic, federalist #10 Madison discusses the dangers a majority faction, the system is made so decisions is made off of law and not biased , the way, federal judges are picked seems to be based off of social class

    The war on terror is different and not like traditional war like how the military has battles or war between nations, the war on terror was terrorists using “ unconventional tactics”rather than military operations. 

    The roving wiretaps seems to violate the fourth amendment which means law enforcement can obtain a single search warrant to wiretap devices , supporters of it feel wiretaps are needed to deal with terrorists but on the other hand non supporters feel it can lead to privacy violations who comes in contact with the suspect

    Same for sneak peek and warrants the pros is it allows investigators to search for drugs etc without notice so that no one can cover up the investigation but the cons are they will be able to use this for things other than terror cases and for minor things, which would cause many more issues which violates the fourth amendment as well

    The first of the two freedoms is the establishment clause which prevents the establishment of religion so no law can pertain to a establishment of religion 

    The Supreme Court case Texas v Johnson ruled that flag burning represents symbolic speech which is protected yes by the first amendment, ruling it protected under the constitution 

    I plead the fifth means they’re pleading their fifth amendment basically invoking it so they don’t have to testify against themselves and risk incriminating themselves basically meaning they have right to stay silent 

    In a confederation, citizens are involved with the regional government  where they hold most power , and the central government has limited authority. In a unitary system, citizens interact with the central government, which holds all the power, with regional governments having limited 

    How i understand the division of power is  that it is the different levels of the federal  government like different government has the power to do certain/ different things “ the constitutional provisions of which governmental powers are divided”

    The federal government particularly in Covid provided resources and funding as well as regulated a lot of things basically controlling the actions done by everyone in the state , power is divided by different branches to prevent anyone ONE person from becoming too powerful , the federal government controlled everything 

    Faction reminds me Of the different class and the parties the capitalist belong to like democrats, republican etc. 

    According to Federalist #10 the source of wealth is the “various and unequal distribution of property.” The factor that explains why some people get to possess wealth by owning private property, and others don’t 

    I disagree with the explanation of wealth and poverty because it is not discussing the actualities only the classes such as advantages “ republican have over democracy” and not addressing the discrimation that actually causes it. 

    The core mission/ first object of the United States government is “ the protection of these facualities “ “ the protection of different and unequal facilities of acquiring property” this does not surprise me or sound too different because the wealthy will always have more advange over the lower class they will do what they can to make sure the “ unequal” remains “ unequal”

    I was surprised that the federalist 10 argues against pure demography. The concerns were threats to the interests of upperclass, and that a republican form of government would “ better protect against the dangers of faction and tyranny “ which went along with the upperclass and them wanting to keep their power and privilege for as long as they can. 

    1.The wealthy wrote the constitution and the lower class was excluded so the upper classes like merchants and the owners then there was the lower class like slaves and servants and voting women

    2.I would say it’s different because we aren’t actually slaves, but there is laborers who are working for the wealthy. there is also a lot of controversy over men being more powerful than woman, but back then it was actually ruled with majority of the men being the owners which made them Able to vote etc. there is a lot of similarities but in the early society it was literally divided by wealth, ownership and social status . In todays society there are other things apart of our social class and more resources for us to have more opportunity . But we still do experience racial inequality’s , gender inequality etc

    The people who wrote the constitution was concerned with protecting the interests of their own wealth and socioeconomic status, not the majority of the population. they believed that democracy, ruled by the common people, was the “worst of all political evils” and that the propertyless majority posed a threat to the established social order.

    The statistic that surprises me the most is the fact that labors are not paid what they deserve, and their actual value that they are working in the capitalist is making the most profit off of their labor.

    A huge implication of living in a society that has such huge wealth inequality would be that work in class will always have to depend on capitalist because I need to pay for their basic needs, whereas capitalist are living freely off of the labor of these people who are trying to make a living for themselves
