Linda Li – Just Laws v. Unjust Laws

  1. According to MLK, how can we tell the difference between just and unjust laws? Understanding this questions is the most important part of this module, and I will ask it again during our second exam.

According to Martin L King’s letter from Birmingham Jail (1963), he demonstrates the difference between just and unjust laws is a just law is legislated by men that conforms to the laws of morality and the laws of God. However, unjust laws are the opposite, they are also made by men, but advocate superiority but tear down the inferiority which are totally apart from the morality and the laws of God. 

2. In your view, is this an important distinction (between just and unjust laws), do you think it makes a difference in the way someone (as an individual, or our society as a whole) lives their lives? Can it affect our politics?

In pondering this question, in my perspective it’s important to distinguish between just and unjust laws. Any law that can enhance human’s character and morals is just. But unjust laws hinder the progress of society and harm people’s psychology profoundly, as it damages individuals lives. It has a negative effect on our politics because they will influence the system to have more unjust laws.

3. Based on our discussion of Question 1, give an example each, of an unjust and just law, in the US today. Explain what makes it unjust or just (using MLK’s definition of those two types of laws).

I consider freedom of religion to be a just law. According to the First Amendment to the U.S. Constitution that  we all have the right to practice any religion of our choice. An example of unjust law is Suspended Drivers Licenses. In 38 states, anyone can lose their driver’s license if they cannot afford to pay their court debt, even for minor offenses like littering that have nothing to do with traffic safety. In my view it’s completely unfair, because financial issues can’t be related to driver license. Obviously having a driver license means an individual has the ability and skill to drive a car, but can’t afford a debt should be separate.
