D.B 12.1

In the case of Wal-Mart the Supreme Court ruled in Wal-Mart’s favor because the believed that the plaintiffs did not have enough in common to constitute as a class for a class action suit.

DB 11.1

The Supreme Court is not influenced by public opinion, it is not easily swayed by popular opinion. They are not elected by people but appointed by the president and confirmed by the senate and they last a lifetime. They follow the law, respected the constitution and protects the rights of individuals.

Many people would agree that the Supreme Court is an anti-democratic part of our government, I think it has to be, to be able to protect minority against the majority as it was designed to do so. They handle tough and controversial issue from gay rights to abortions.

DB 9.2

It’s a new type of war because it plays with people’s fears and emotions. It creates fears in ourselves that was never there. Giving no specific enemies where as traditional wars we have a specific target or enemy.

A “roving wiretap” is a special permit given to law enforcement that allows them to follow the surveillance target. It seem to be a violation of the 4th Amendment, the right to privacy.

A “sneak peek” is a search warrant that give authorization to law enforcement to enter someone’s private premises without their permission or knowledge, again a violation of the 4Th amendment.

DB 9.1

1. The Establishment clause is a clause in the First Amendment of the U.S Constitution that forbids congress from establishing a state religion, it prevents any passage that gives or force the believe of anyone Religion. The lemon test was set up by the government to determine whether the clause is in violation.

2. The First Amendment protects the burning of flag because it is considered as freedom of speech which is protected by the first amendment.

3. Pleading or “taking the fifth” means that a person have the rights to remain silent as to not incriminate themselves.

DB 7.1

1. the primary differences in the role of citizens in government, among the federal, confederation, and unitary systems : the federal government system divides power between the state and government which allows the people to vote, while the confederation each country has its own independent sovereignty because confederation is not a sovereign country therefore there is no unified constitution

2. Division of power system divides the powers between the three branches: executive, legislative and judicial.

3. The government to me didn’t seem to be taken the outbreak as serious as they should have at the beginning. They were unprepared for the outcome I guess it is to be expected since the virus took everyone by surprise. But The federal , NY state and local governments step up by providing citizens with stimulus checks, unemployment, and other support and resources to restore economy. Ensured safety health by requiring citizens to wear masks, encouraged them to get tested and vaccinated. They provided people to test I public schools, I was tested every week as I work at a public school

DB 6.2

  1. Two concepts we discussed in class that reminds me of “Faction” are Political parties and Social class
  2. According to federalists #10 the source of wealth is the faculties of men, which refers to their positon in society and also what they inherits.
  3. Yes the rich are still rich and the poor are still poor
  4. The core mission of the US government has been to protect the wealth of the owning class and making them richer by given them ways to do so. Not surprising the wealthy always look out for each other.
  5. No surprise that federalist #10 is not in favor of the Democratic party , believing that the Republican can protect the interest of the wealthy class its only right that they favor the Republican party instead.

DB 6.1

  1. Capitalist class wrote the US Constitution. The middle working class were excluded in the process, people who did not own any land or were in debt, women, African Americans, and Native Americans.
  2. To me I think its 50/50 somethings have changed and some haven’t. Wealthy people still have power, still getting things done their way but I think that the working class have a chances to advance with hard work to become part of the wealthy class.
  3. They feared that the working class would rise up against them as they knew. The majority of the population is made up of working class people and they wanted them to stay that way. They also wanted to keep their power to totally control the lower and working classes.

DB 5.2

The formula M-C-M’ explain how capitalists maintain and increase their wealth. M is currency, C is a commodity, M’ represents surplus value, M’ is greater than M.

To maintain their wealth and increase it, Capitalists realized that not only do they have to buy commodities to resell, they also have to invest their capitals in buying building, machinery, equipment, raw materials and labor force to produce more commodities to earn more money.

DB 5.1

1.Production is the process of making or creating something from raw materials for example creating furniture, paper etc. Labor is the physical and mental work or effort used to produce goods.

2.Value is the worth of an object or service bring in. Something can become valuable by their importance it have to the owner.

3.The value of something is determine by the amount of time and effort put into the Labor. The amount of labor put into the production of a product increases its value.

4.Labor is what people do to produce goods and services. Labor power is what workers sells to their employers.

5.Surplus Value is the difference between the amount raised from selling a product and the amount it cost the owner to manufacture said product.

DB 4.2

1.The Owning class lives of their investments, stocks, bonds, rents, royalties and other property incomes while the Employees work for a living, they live off their salaries, wages and fees.

2. Smith is saying that without labor there’s no value in wages and salary because labor is the true value of all commodities , basically the employee to me are the true value of a company and without them there is no company.

3.Class represents a person’s social standing in society. In this country a person can “rise above” the class they were born into with hard work and dedication, just because you were born poor doesn’t mean you have to be poor. I don’t believe it’s a person’s identity, it does not define who you are as a person

4.A close form of dependency can be between owner and worker, consumers. The owners depends on the workers to produce product to make money and the workers depends on the owners and consumers to earn money.
