1. The Establishment Clause and Lemon Test
The Establishment Clause is part of the First Amendment. It means the government can’t create or support an official religion and has to stay neutral. The Lemon Test (Lemon v. Kurtzman) checks if a law violates this. It has three parts:
- It must have a non-religious purpose.
- It can’t help or hurt religion.
- It can’t create too much government involvement with religion
2. Flag Burning and the First Amendment
Yes, burning the U.S. flag is protected free speech. In Texas v. Johnson (1989), the Supreme Court ruled that flag burning is symbolic speech, and the government can’t punish people just because it’s offensive.
3. Taking the Fifth
Saying “I’m taking the Fifth” means using your Fifth Amendment right to stay silent so you don’t say anything that could be used against you in court.
