A law must the pass the 3 criteria of the Lemon Test, if it fails any part of the test, it is considered to be unconstitutional. <\/li>\n\n\n\n<li>Yes, burning the US flag is protected by the First Amendment. In the Supreme Court case Texas v. Johnson in 1989, Johnson was arrested for burning a flag during a political protest. The Court stated that the flag burning was a form of symbolic speech, which is protected under freedom of speech and ruled in favor of Johnson. <\/li>\n\n\n\n<li>When someone says, &#8220;I&#8217;m taking the Fifth&#8221;, it means that they are choosing not to answer a question because their answer can incriminate them.
