Dukes ruled that the group of women suing Wal-Mart for gender discrimination could not continue their class-action lawsuit. The Court examined the requirement of &#8220;commonality&#8221; which demands that all class members share identical legal or factual questions. The justices determined that the women failed to demonstrate sufficient evidence of a company-wide discriminatory policy which impacted all employees equally. The company&#8217;s pay and promotion decisions operated through individual local managers so there existed no single company-wide policy responsible for the alleged discrimination.
