Give an example to illustrate your argument.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">There are a number of ways in which the court system is better suited to protect the individual than are the elected branches of government. One way is that the court system is designed to be insulated from the political process. This means that judges are not subject to the same kinds of pressures that elected officials are. For example, judges are not beholden to special interests or to the demands of party bosses. This insulation allows judges to make decisions based on the law and the facts of a case, rather than on political considerations. Another way in which the court system is better suited to protect the individual is that it provides a forum for the airing of grievances that might not otherwise be heard. This is especially important in cases where the individual is up against the government or a powerful corporation. The court system provides a level playing field on which the individual can assert his or her rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. Think about how federal judges get to become judges \u2013 unlike Presidents, Mayors and members of Congress (and other legislatures), they are not elected, but rather\u00a0<em>appointed<\/em>. Many Americans have thus called the federal courts system, and especially the Supreme Court,\u00a0<strong>anti-democratic\u00a0<em>PLACES IN OUR GOVERNMENT.\u00a0<\/em><\/strong>Do you agree that the Supreme Court, for example, is an anti-democratic part of our government? What could be the reason for this way of choosing judges in federal courts? (HINT: think about our discussion of \u201cFederalist #10\u201d, and which social class plays a leading role in our government system.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court is an anti-democratic part of our government because it is not elected by the people. The reason for this is because the Constitution gives the President the power to appoint justices to the Court. This means that the President has the power to choose who will be on the Court, and the people have no say in who is appointed. This can be seen as an undemocratic way of choosing judges, as the people are not given a say in who is appointed to the Court. This means that the Court is not representative of the people, and is not accountable to them. The Court is also not subject to the same checks and balances as the other branches of government, as it is not elected by the people. This means that the Court can make decisions that are not in line with the wishes of the people, and that it is not accountable to them. The Supreme Court is an anti-democratic part of our government, and this is a problem. The Supreme Court has the power to strike down laws that are passed by Congress and this can be seen as an undemocratic power. The court also has the power of judicial review, which means that it can declare laws unconstitutional. This power is not explicitly given to the court in the Constitution, but it has been assumed by the court over time.
